Wink Epic v. Apple fight: Billions at stake as judge determines fate of App Store

The fate of Apple’s (AAPL) lucrative App Store was placed in the hands of a California federal judge Monday, following closing arguments from lawyers for the tech giant and its opponent, “Fortnite” developer Epic Games, in their widely watched antitrust trial.
At issue in the court battle, which ran about three weeks, is Epic’s claim that Apple operates the App Store as an illegal monopoly by forcing developers to distribute its app exclusively through the App Store and exclusively use Apple’s payment processing services requiring them to pay the iPhone maker a 30% commission on app sales.
Epic is asking Judge Yvonne Gonzalez Rogers to issue an injunction requiring Apple to change its business model, so app developers can get their apps onto iPhones using third-party app stores, effectively cutting out Apple’s 30% fee. But Apple says such a change would jeopardize mobile device security, with CEO Tim Cook testifying last week that such a move was “an experiment I wouldn’t want to run.”
Apple doesn’t break out revenue for the App Store, instead bundling the marketplace with its Services business alongside Apple Music+, Apple TV+, iCloud, and other sources. Still, the segment totaled $53.7 billion in 2020, or roughly 20% of Apple’s $274 billion in total revenue for the year, with in-app purchases on gaming apps representing the App Store’s dominant revenue source.

Gonzalez Rogers said with 4,500 pages of testimony to review she hopes to issue her written decision in the coming weeks or months, when she could grant all, part, or none of Epic’s requests in the case.
'The courts are very careful in antitrust cases'
The dispute began when “Fortnite,” with about 350 million registered players, was booted from Apple’s and Google’s (GOOG, GOOGL) app stores in August, and banned from their operating systems, after Epic circumvented the platforms by offering direct, in-game purchases at a 20% discount.
Apple and Google both said the move violated their terms of service, justifying removal from the stores. Epic filed separate lawsuits against Google and Apple, claiming the removals violate federal and California antitrust laws. Apple also countersued Epic in the antitrust lawsuit for breach of contract.
In issuing her opinion, Gonzalez Rogers may not hand an absolute victory to either Apple or Epic, Syracuse University College of Law professor Shubha Ghosh told Yahoo Finance.
“The courts are very careful in antitrust cases,” Ghosh said. “I don't think they want to destroy a company by any means. I think the judge...is careful to see the arguments on both sides and what the effects would be for its decision, whether it rules in favor of the defendant, or whether it rules in favor of the plaintiff. So I would imagine the judge would take a fairly narrow ruling.”
While Apple’s App Store takes a 30% cut of sales from larger developers, after Epic filed suit it began reducing commissions for companies that make less than $1 million in revenue per year to 15%. Subscription services also have separate requirements, with developers paying 30% for the first year of a subscription, and 15% for each subsequent year. Free apps remain free, with Apple taking no commission from developers for downloads.

The bulk of Gonzalez Roger’s questioning Monday focused on how she should define the market relevant to the case, a critical step that will impact its outcome, including any remedies the court may impose on Apple if it’s found to be violating antitrust law.
Lawyers for Epic argued that the market central to Apple’s alleged anticompetitive conduct should be defined narrowly as app distribution, or in other words, how apps get onto the iPhone.
Apple’s lawyer disagreed, saying no separate market for app distribution exists because it has never separately licensed iOS or its App Store. Instead, they said, the relevant market is the broader mobile device market, where it faces fierce competition from dozens of manufacturers of Android-based mobile phones and tablets, and gaming consoles like Microsoft’s Xbox and Nintendo’s Switch.
“Apple's business model was developed long before it had anything that anyone claimed was market power,” Apple’s lawyer argued, saying that model more effectively protects users from malware and other security and privacy breaches than Android-based devices.
The tech giant’s lawyers also positioned Apple’s less malware-ridden ecosystem as a market alternative to Android’s mobile operating system — an option that it said would be squashed, and lessen competition for mobile devices, if it opened its software to outside players.
“The iOS environment would be turned into the equivalent or perhaps even a poor annotation of Android. And that eliminates consumer choice,” Apple’s lawyer told Gonzalez Rogers of one possible outcome discussed during the trial.
'The benevolent overlord of this ecosystem'
Epic countered the argument by pointing out that Apple has accommodated requests from the Chinese government to remove App Store content. (Epic has its own connections to China: Chinese internet megacorporation Tencent holds a 40% stake in the developer.)
Epic’s arguments during the trial also focused on Apple’s so-called ecosystem. The developer argued that by limiting consumers’ ability to use apps bought through the App Store on Apple devices, the tech giant ensured that customers would continue to use Apple products like the iPhone, or risk losing the apps they’ve previously purchased.
“They’re the benevolent overlord of this ecosystem,” Epic’s lawyer, Gary A. Bornstein, said of Apple’s argument that its iOS is inseparable from its App Store. “Let us continue to do it without competition,” he said sarcastically, “because it’s worked out for us so far? That is not a defense under the antitrust laws.”
Gonzalez Rogers was, however, skeptical of how Epic’s claims in its similar antitrust case pending against Google and its Google Play store could coexist with Epic’s push for Apple to allow other app stores on the company’s devices. How, she asked, could Epic also maintain antitrust claims against Google’s Android when third-party stores are already available on the operating system?

If a hypothetical Epic Games store were to come into the App Store, Apple’s attorney argued that the situation would be unfavorable for Apple, Epic and consumers, with Epic Games having to agree to provide Apple with the code from every game it offers. “So now we have a store, within a store, within a store…”
The judge also had probing questions for Tim Cook, who made a rare court appearance on Friday. Asked about Apple’s treatment of in-app purchases, and why Apple refuses to allow app developers so much as a mention that customers can make purchases outside of the App Store, Cook said it would take away Apple’s payoff for the effort it makes in acquiring the customer.
“It would be akin to Apple down at Best Buy saying Best Buy put in a sign there, where you’re advertising that you can go across the street to the Apple store and get an iPhone,” Cook explained in an analogy offered early during his testimony.
While Wedbush analyst Dan Ives predicted that Apple would win its court battle with Epic, he pointed out that the tech giant has also faced antitrust scrutiny in both the European Union and the U.S. In October, House Democrats issued a damning report on Big Tech finding that the App Store allowed Apple to “generate supra-normal profits.”
“We continue to believe Apple comes out with a victory in this Game of Thrones battle, but clearly risks exist if the Judge goes against Apple,” Ives said. “We believe Apple winning the Epic case will remove a major overhang on the stock, although Big Tech remains in regulatory scrutiny for years to come.”

Wink Samsung just showed off new smartphone tech that’s blowing people’s minds

When Samsung’s first Galaxy Fold arrived in 2019, it felt more like a proof of concept for foldable smartphones than a viable product to compete with the iPhone. A year and a half later, Samsung has released two more flagship foldables — the Galaxy Z Flip and Galaxy Z Fold 2 — and the progress is impossible to ignore. Foldable phones weren’t ready for primetime in 2019, but they are getting closer all the time, and Samsung is committed to being at the front of the line when they finally break through. It proved that once again at Display Week 2021.

This Monday, Samsung showcased a number of next-generation OLED displays at the Display Week 2021 exhibition put on by the World Information Display Society (SID). These aren’t actual products (at least not yet), but they help to give consumers an idea of what the new displays will be capable of when they arrive.
What’s better than a phone that folds once? How about a phone that folds twice? The S-Foldable display would allow a phone to do just that, maxing out at 7.2 inches and folding in or out to significantly increase the surface area of the display or make it compact enough to slide into even the smallest pocket.
Samsung also showed off a 17-inch foldable laptop, which is one massive, foldable display that can be propped up at an angle to serve as a laptop with a touchscreen keyboard, folded in half to turn into a tablet, or unfolded all the way out to create a large screen that could be used to present something to other people.
The most intriguing reveal was the Slidable display, which can be slid out from a device horizontally to expand the screen size for watching videos or multitasking. Once the user is finished using the slidable portion of the screen, they can slide it back in to reattain the form factor of a standard smartphone.
Finally, Samsung gave us a sneak peek at its Under Display Camera, which is a front-facing camera for portable devices that sits under the display panel in order to eliminate the need for holes or notches. As you can see in the video below, Samsung is currently demoing the UDC technology on notebooks:

“Samsung has always strived to not just deliver vibrant and beautiful displays, but also products that provide a useful and practical experience,” said Samsung Display head Joo Sun Choi in a press release. “Samsung Display will keep developing various self-luminous technologies including OLED, QD, and LED. It will take the lead in growing the market by providing display solutions in various sizes ranging 1-inch to 200-inch.”

While the iPhone 12 release was staggered across October and November due to the coronavirus pandemic, credible sources have indicated that all of Apple’s new iPhone 13 models will arrive in stores by September.
That, however, isn’t a reason to disregard this rumor completely. On the contrary, Apple in the past has released new iPhone color models months after the initial launch. We’ve seen Apple do this a few times with its (Product) Red iPhone models and, most recently, we saw Apple introduce a brand new purple iPhone 12 at its recent media event in late April where we saw Apple unveil new iMacs, a new Apple TV, and, of course, the AirTag.

It’s also worth mentioning that Apple in recent years has started to explore new iPhone color options on a consistent basis. In some instances, Apple will introduce a color one year, only to replace it entirely with a different color the next year. As a prime example, the Midnight Green color option on the iPhone 11 Pro was replaced with a Pacific Blue option on the iPhone 12.
So while we can’t speak to the accuracy of the pink iPhone 13 rumor specifically, Apple’s recent history has given us enough evidence to, at the very least, not discard it out of hand.
New color options aside, we’ve seen reports indicating that the iPhone 13 will include an Always-On Display, similar to what we’ve already seen on the Apple Watch. According to reports, the Always-On Display will only show users the time, battery percentage, and incoming notifications.
Noted leaker Max Weinbach said the following earlier this year:

Notifications seem to be displayed using a bar and icons. Upon receiving, the notification will pop up normally except that the screen will not entirely light up. Instead, it will display it just like you’re used to right now, except dimmed down and only temporarily.
Other iPhone 13 features we can look forward to include a 120Hz ProMotion display, Portrait Mode support for video recording, a smaller notch, and more advanced camera functionality across the board. And though it’s a feature many iPhone users want, there’s no indication we’ll see the return of Touch ID to the iPhone anytime this year.

When Apple introduced Face ID on the iPhone X, it was something of a bold, and arguably risky, design move. Not only did Apple implement a brand new authentication technology at scale, but it also did away with Touch ID which, at that point, was incredibly reliable, easy to use, and familiar. Despite some initial trepidation from folks who had grown accustomed to Touch ID, the transition from Touch ID to Face ID was thankfully pretty seamless.
For as great as Face ID is, there are still some use-case scenarios where Touch ID provides a superior user experience. As a prime example, Touch ID enabled users to initiate and complete the authentication process while the device was still in one’s pocket. Face ID has gotten much quicker in recent years, but it’s still a tad behind Touch ID when it comes to unlocking speed.
Additionally, the coronavirus pandemic necessitated the use of face masks for hundreds of millions of people across the globe, a dynamic that makes unlocking via Face ID impossible.

Taken together, there’s been something of a clamoring for Apple to bring back Touch ID. Indeed, we’ve even seen some speculative reports — some emanating from credible sources — which claim that Apple is in fact working on bringing Touch ID back via a fingerprint sensor located underneath the display or, perhaps, on the power button itself.
In light of this, a recent survey from SellCell reveals that the return of Touch ID is actually the feature iPhone users want the most.
Breaking things down, here are the most wanted iPhone 13 features per the survey:

  • Return of Touch ID – 21%
  • Higher refresh rate display (120Hz) – 17%
  • Smaller notch / Notch-less design – 15%
  • Return of in-box charger – 12%
  • Bigger battery – 11%
  • Better camera features – 8.2%
  • Faster processor – 6.8%
  • Compact phone – 5%
  • Better waterproofing – 2.2%
  • Foldable design – 1%
  • Removal of lightning port – 0.8%
To be honest, I’m a bit surprised that Touch ID scored so high, but it’s certainly possible that a full year of unlocking frustration due to constant mask-wearing boosted the figure higher than it would be ordinarily.
That notwithstanding, there doesn’t seem to be any chance we’ll see Touch ID return on the iPhone 13. According to reputable analyst Ming-Chi Kuo, Apple’s under-display fingerprint recognition technology likely won’t arrive until the iPhone 15 in 2023 at the earliest, if at all.
As to the other features mentioned in the aforementioned survey, a few of them will actually debut on the iPhone 13. The iPhone 13 Pro models, for example, will reportedly boast a 120Hz ProMotion display for improved responsiveness and more fluid scrolling. It’s also believed that Apple’s implementation will include dynamic variable refresh switching such that the display will be able to alternate between 60Hz and 120Hz based on the use-case environment.
Further, product leaks have suggested that the iPhone 13 lineup will feature a smaller notch that will measure 26.8mm. As a point of reference, the width of the notch on the iPhone 12 checks in at 34.83mm.

All told, the notch will not be nearly as wide but will be slightly taller. Other likely iPhone 13 features include Portrait mode support for video recording, an Always-On display feature, and improved camera performance.
As far as the iPhone 13 release date is concerned, credible sources have relayed that the entirety of Apple’s iPhone 13 lineup — which will consist of four devices — will be released in September. And while nothing is official just yet, Apple will presumably hold a special media event in early September to unveil its next-gen iPhone lineup.

Musk did say that Tesla would not sell any of the bitcoin owned by Tesla currently, and would use it again “as soon as mining transitions to more sustainable energy.” In the meantime, he said Tesla will look at other cyrptocurrencies that use less energy to mine.

While bitcoin has been seen as a potential payments option since its inception, dogecoin was largely conceived as a joke. The crypto has seen a stunning increase, however, since Musk adopted it as a meme and began tweeting about it earlier this year, including strong gains last week before the billionaire’s guest-hosting appearance on “Saturday Night Live.”

Immediately after Musk’s tweet Thursday, dogecoin prices jumped from less than 43 cents apiece to more than 50 cents. As of Thursday night, dogecoin was up 20% since Musk’s tweet, to about 47 cents, according to Kraken data. Bitcoin declined from about $54,500 a coin to less than $50,000 in the 24 hours after Musk’s announcement of Tesla’s move.

Musk clarified his comments Thursday, tweeting “I strongly believe in crypto, but it can’t drive a massive increase in fossil fuel use, especially coal.”

  Israel strikes Gaza home of Hamas leader, destroys AP office

GAZA CITY, Gaza Strip (AP) — Israel slammed the Gaza Strip with airstrikes on Saturday, in a dramatic escalation that included bombing the home of a senior Hamas leader, killing a family of 10 in a refugee camp — most of them children — and pulverizing a high-rise that housed The Associated Press and other media.
The Hamas militant group continued a stream of rocket volleys into Israel, including a late-night barrage on Tel Aviv. One man was killed when a rocket hit his home in a suburb of the seaside metropolis.
With a U.S. envoy on the ground, calls increased for a cease-fire after five days of mayhem that have left at least 145 Palestinians dead in Gaza — including 41 children and 23 women — and eight dead on the Israeli side, all but one of them civilians, including a 5-year-old child. U.S. President Joe Biden, who has called for a de-escalation but has backed Israel’s campaign, spoke separately by phone with Israeli Prime Minister Benjamin Netanyahu and Palestinian President Mahmoud Abbas.
Still, Israel stepped up its assault, vowing to shatter the capabilities of Gaza’s Hamas rulers. The week of deadly violence, set off by a Hamas rocket Monday, came after weeks of mounting tensions and heavy-handed Israeli measures in contested Jerusalem.
On Saturday, Israel bombed the home of Khalil al-Hayeh, a senior figure in Hamas’ political branch, saying the building served as part of the group’s “terrorist infrastructure.” There was no immediate report on al-Hayeh’s fate or on any casualties.
The bombing of al-Hayeh's home showed Israel was expanding its campaign beyond just the group’s military commanders. Israel says it has killed dozens in Hamas’ military branch, though Hamas and the smaller group Islamic Jihad have only acknowledged 20 dead members.
Since the conflict began, Israel has leveled a number of Gaza City’s tallest office and residential buildings, alleging they house elements of the Hamas military infrastructure. On Saturday, it turned to the 12-story al-Jalaa Building, where the offices of the AP, the TV network Al-Jazeera and other media outlets are located, along with several floors of apartments.
“The campaign will continue as long as it is required,” Netanyahu said in a televised speech on Saturday evening. He alleged that Hamas military intelligence was operating inside the building. Israel routinely cites a Hamas presence as a reason for targeting certain locations in airstrikes, including residential buildings. The military also has accused the militant group of using journalists as human shields, but provided no evidence to back up the claims.
The AP has operated from the building for 15 years, including through three previous wars between Israel and Hamas, without being targeted directly. During those conflicts as well as the current one, the news agency’s cameras from its top floor office and roof terrace offered 24-hour live shots as militants’ rockets arched toward Israel and Israeli airstrikes hammered the city and its surroundings.
In the afternoon, the military called the building’s owner and warned a strike would come within an hour. AP staffers and other occupants evacuated safely .
Soon after, three missiles hit the building and destroyed it, bringing it crashing down in a giant cloud of dust.
“The world will know less about what is happening in Gaza because of what happened today,” AP President and CEO Gary Pruitt said in a statemen t. “We are shocked and horrified that the Israeli military would target and destroy the building housing AP’s bureau and other news organizations in Gaza.”
“This is an incredibly disturbing development. We narrowly avoided a terrible loss of life,” he said, adding that the AP was seeking information from the Israeli government and was engaged with the U.S. State Department to learn more.
Mostefa Souag, acting director-general of Al-Jazeera Media Network, called the strike a “war crime” aiming to “silence the media and to hide the untold carnage and suffering of the people of Gaza.”
Later in the day, White House press secretary Jen Psaki tweeted that the U.S. had “communicated directly to the Israelis that ensuring the safety and security of journalists and independent media is a paramount responsibility.”
In the early hours Saturday, another airstrike hit an apartment building in Gaza City’s densely populated Shati refugee camp, killing two women and eight children.
Mohammed Hadidi told reporters that his wife and her brother’s wife had gathered at the house with their children to celebrate the Eid al-Fitr holiday ending the Islamic holy month of Ramadan. The only survivor was Hadidi’s 5-month-old son, Omar.
The blast left the children’s bedroom covered in rubble and smashed the salon. Amid the wreckage were children’s toys, a Monopoly board game and, sitting on the kitchen counter, unfinished plates of food from the holiday gathering.
“There was no warning ... You filmed people eating and then you bombed them?” a neighbor, Jamal Al-Naji, said, referring to Israel’s surveillance over the Gaza Strip.
The Israeli military did not immediately respond to a request for comment.
In his call with Netanyahu, Biden expressed his “strong support” for Israel’s campaign but raised concern about civilian casualties and protection of journalists, the White House said.
The bombings took place a day after U.S. diplomat Hady Amr arrived in Israel as part of Washington’s efforts to de-escalate the conflict. Israel turned down an Egyptian proposal for a one-year truce that Hamas rulers had accepted, an Egyptian intelligence official said Friday on condition of anonymity to discuss the negotiations.
Mediators from Egypt, which works closely with Israel on security issues and shares a border with the Hamas-ruled Gaza Strip, appeared to be growing alarmed. The intelligence official said Egypt hopes the U.S. intervention could halt the Israeli assault. The U.N. Security Council was set to meet Sunday.
The tensions began in east Jerusalem earlier this month, when Palestinians protested attempts by settlers to forcibly evict a number of Palestinian families from their homes and Israeli police measures at Al-Aqsa Mosque, a frequent flashpoint located on a mount in the Old City revered by Muslims and Jews.
Hamas fired rockets toward Jerusalem late Monday, triggering the Israeli assault on Gaza. Since then, Hamas has fired more than 2,000 rockets, though most have either fallen short or been intercepted by anti-missile defenses. Israel’s warplanes and artillery have struck hundreds of targets around blockaded Gaza, where some 2 million Palestinians live.
The turmoil has also spilled over elsewhere, fueling protests in the occupied West Bank and stoking violence within Israel between its Jewish and Arab citizens, with clashes and vigilante attacks on people and property.
Palestinians on Saturday marked the Day of al-Nakba, or “the Catastrophe,” commemorating the estimated 700,000 people who were expelled from or fled their homes in what was now Israel during the 1948 war surrounding its creation. Thousands of Arab Israelis marched in a Nakba rally in the northern Israeli city of Sukhnin, and scattered protests took place in the West Bank.
Palestinian health officials reported the deaths of two Palestinians by Israeli fire in the West Bank on Saturday. One of the shootings occurred when the army said it thwarted an alleged car ramming.

We’re still about four months out from the launch of the iPhone 13, but rumors and leaks have been popping up at a furious pace in recent months. According to those leaks, one of the most likely design changes coming to the iPhone 13 is a smaller notch, which many iPhone owners have been clamoring for since the iPhone X launched in 2017. This alteration seemed inevitable, and the only question was how the company was going to make it happen. Now, thanks to a new report from Digitimes, we might know the secret behind the shrinking notch.
Citing industry sources, Digitimes reports that Apple has figured out a way to reduce the size of the VCSEL (vertical-cavity surface-emitting laser) chips that are used in the Face ID sensors by 40-50% in new iPhone and iPad models set to roll out later this fall. Not only could this assist Apple in making the notch take up less room, but it should also help Apple cut production costs, as even fewer wafers will need to be produced for the chips.
Providing the leaks that we’ve seen over the past few weeks are accurate, we already know what to expect when it comes to the design of the iPhone 13. Back in April, leaked images of a purported screen protector for the iPhone 13 made it clear that the sensor housing will be significantly smaller this time around. That assertion has been backed up by subsequent leaks, including a video from Unbox Therapy showcasing an iPhone 13 Pro Max dummy model which had been built with the specifications of all the latest rumors and reports in mind.

Scaling down the chips is one way that Apple could achieve a smaller notch on the iPhone 13 lineup, but it’s certainly not the only way. Other reports claim that Apple will push the earpiece speaker from the center of the notch to the top, where it will sit in the bezel that surrounds the display. This would let Apple pack all of the sensors within the housing closer together, eliminating the need for such a wide notch at the top of the screen.
The notch will likely be the design element that we’ll all be tracking when Apple unveils the iPhone 13 in September, but it won’t be the only element of the iPhone to get a makeover. KGI Securities analyst Ming-Chi Kuo has claimed the iPhone 13 Pro and iPhone 13 Pro Max will come with upgraded Ultra Wide cameras that have apertures of f/1.8 and autofocus instead of fixed focus. The camera modules of the dummy unit seemingly reflect that, and as a result, the lenses are noticeably larger than they were on the iPhone 12 series.
